Last year Environment Canterbury (aka ECan) issued consents to two water bottling companies that allow them to bottle over 24 million litres per day of precious Canterbury aquifer water from bores in Belfast, North Christchurch.  

The consents are based on historical permits for the Silver Fern Farms works and the Kaputone Wool Scour. Those industries used only a tiny fraction of the consented water ‘take’ but the bottling companies will be using every last drop. 

The aquifer is fully allocated and ECan doesn't understand the potential effects of the increased extraction on artesian pressures and water quality; on freshwater ecosystems; on neighbouring bores; or on the community water supply, because there have been no assessments.  Despite this they've bent over backwards to find a process that will enable the bottling to go ahead without public consultation.  We'll be challenging the legality of that process.

 

At the time of writing this nearly 90,000 people had signed Genevieve Robinson's petition calling for the  consent to be revoked. 

However, construction is going ahead and a new bore has been drilled. 

 

We don't want NZ to stop at protest when we can use the law to protect our water.  We have an opinion from a top Queen's Counsel that we have a strong case and we're ready to bring legal proceedings to overturn the Belfast bottling consents.  But we need your help...

We estimate we will need at least  $40,000  to cover court fees and costs.  

However, if we win (and we believe we will), we may be able to recover costs.  Any funds left over or any money received beyond the $40 000 target will be used to support other communities in need of legal assistance to protect their water resources.  We have big plans!

Operation 'Stop the bottling!' - can you help AWA to 'go another round' against the water bottlers?

If you've received this email you've donated to stop the bottlers at least once before.

Cutting to the chase, AWA lost its case in the High Court against ECan and the bottlers. So we got a second legal opinion - on the Judgement and on our chances on appeal. Happily, the advice was that our case is winnable so we have filed with the Court of Appeal.

The Judgement we're working to overturn allows 2 companies to use over 8 billion litres of Christchurch's aquifer water for water bottling EVERY SINGLE YEAR.  It also increases the rights of the holders of water permits - making it much more likely they can hold on to their water if they want to use it for another purpose, despite the catchment being fully allocated.  And this will support the market for water via land sales that is already established in Christchurch. 

Basically, if we don't suceed in overturning this judgement we will have made things worse not better, so we feel a huge responsibility to do everything we can to get a win in the Court of Appeal. To do that, to run the case, we need to raise at least $50,000... so we have started another PledgeMe campaign!

Two weeks 'in' and we've raised almost $10,500 on Pledgeme and around $4000 in bank donations.  So we have a way to go but we're getting there! It's a reachable target.

Thanks so much for helping us get to our target - ECan and the bottlers are now heading to Court!

The first small Hearing will likely be in a few weeks time. That will address an affirmative defence raised by Cloud Ocean Water - essentially they want to be certain the original consent that was transferred from Kaputone Wool Scour can't be used for bottling water.  How we proceed - and whether we can address the processing of and use of subsequent consents granted by ECan - will depend on the outcome of that Hearing.    

We'll keep you updated as things progress.

We also now have a list of the rewards you've requested and we'll start sending those out as soon as we can.

If you've requested to be in a draw please bear with us as we have to wait until all pledges have been received and there is still some time before that deadline passes and we get the final list. We'll send you an email once the draw is complete - whether or not you win (GOOD LUCK! )

On April 7th - next Saturday - at 12pm Aotearoa Water Action is CHALKING a "Message to ECan" at Cathedral Square.

We're asking everyone who cares about our water to join us - even for 10 minutes - to chalk a (G-rated) message or two to ECan: a picture, a poem, a demand, a hope, or simply a feeling...that's up to you.  Get creative! 

It'll be a fun, positive, family-friendly protest and we're hoping to see the kids there with chalk in hand asking for rivers they can swim in and clean drinking water.

We aim to show ECan just how strongly we feel about our water and its protection.  And, of course, we need to raise awareness of our Pledgeme campaign (which is now at $17,572 thanks to you).  

This is a great opportunity to meet like-minded people and to take action in a fun and constructive way.  We'd love to see you there!  Please share the link to the event page (above) with your Christchurch friends and encourage people to come along.
