Do you own your own home, farm or land? Chances are these are your biggest assets you own. Protect the fruit of your labour! Join the good fight that will determine the next course of our rights to hold on to our own homes and land!
Our first mission is to fight the draconian land grab policy in the Christchurch High Court starting Monday 22-July-13. We are a group of home owners and land owners who worked hard all our lives, only to be kicked in the guts while we were down. The bureaucrats are taking advantage of the earthquake situation to the detriment of all New Zealanders.
We challenge the lawfulness of:
-
Red zoning- anyone's home and land and render it unsellable, and
-
Arbitrary, unfair compensation- for taking of one's home and land, and
-
Coercive, threatening policies- that intimidate homeowners so that they cannot live where they wish undisturbed by government.
The media are taking considerable interest in our High Court case against the Crown. No doubt TV cameras will be everywhere when the hearing starts. Reporters are being kept informed of our progress. Many MPs are taking a keen interest in the issue. Social media campaigns are underway to build awareness of the injustices that are happening. Visit our FaceBook page and tell your friends about the project!
MORE ABOUT THE COURT CASE:
Quake Outcasts has launched a Judicial Review case at the High Court against Gerry Brownlee and Roger Sutton. They are fighting for our right to self-determination of our own land, and full and fair compensation for appropriation by government if they are forced to give up their properties. If successful in court, there will be far reaching and long lasting implications:
Politicians will not be able to infringe on people's rights by way of drawing a line on the map. Governments will not be able to wiggle out of paying full compensation when they appropriate private property owned by any New Zealander.
This affects every New Zealander. This is why everyone who values the fruit of their labour should concern themselves with this case now being brought before the High Court.
The High Court is Being Asked to:
- Declare that the minister's red zoning decision was unlawful,
- Declare that the 50% land-only RV buy out offer to some red zoned property owners red zoned was unlawful,
- Declare that people who wish to remain where they are be supported by essential facilities as permitted by law.
Why Take the Government to Court:
- Because red zoning takes away our right to live where we want without being interfered with,
- Because red zoning reduces our property values,
- Because red zoning takes away the open market for our properties, so we cannot sell if we wanted,
- Because this government forced its low price offer on us, against the rule of law that guarantees full compensation,
- Because this government threatened to cut off essential services (water, power, sewer, roading) to our homes if we do not accept the offer,
A government must not be allowed to bully its own people. Join us in the good fight against the biggest bully of our time.
Your generous contributions will help pay for the costs of successfully challenging those policies, and set a positive precedent for all New Zealanders who think "what's rightfully mine is mine."
Court Hearing Date: 10 am , Monday 22/7/13 - Wednesday 24/7/13 Location: Christchurch High Court, 282 Durham Street.

Apologies for missing the link in our last update!
Thank you so much for your generous support! Together a total of $6,605 were pledged from 45 pledgers! That's an average of over $140 per pledger- very high for any kind of crowdfunding campaign!
This
time we have set a much more modest target. The funds raised will be
used toward our continuing fight in the
Court of Appeal to protect our property rights, and help pay for a
flight to Geneva later this year when we send a delegate to attend the
UN Universal Periodic Review for Human Rights Pre-Session!
Please donate generously. Every dollar counts! Thank you again!

We won the High Court battle on 26-Aug-13. The Court ruled that:
1. Red zoning was unlawful,
2. Buy out offers were unlawful,
3. Human rights were interfered with, and
4. Residents' property rights are affirmed by the Court.
But it's not over. The minister said he would appeal. This means more stress and worry for affected homeowners, not to mention more legal costs.
Please donate generously! We are fighting for all New Zealanders' fundamental property rights!
